Please write a research essay on the issue of tribunal standing (also known as decision maker participation) in judicial review applications concerning their own decision. You should explain: 1) the current state of the law, 2) the principles underlying it, and 3) whether it is in need of reform. You must read and analyse the recent case of Ontario (Energy Board) v Ontario Power Generation Inc (2015) SCC 44, [2015] 3 SCR 147. Concentrate on Justice Rothstein’s analysis, writing on behalf of the majority, on tribunal standing and ‘bootstrapping’. Do not examine the substance or merits of the decision under review. *You must conduct research using Canadian legal databases. You can cite decisions of the Supreme Court of Canada, Provincial and Territorial superior courts, as well as other relevant and credible secondary sources such as law journal articles. Citation style must be in McGill Guide to Uniform Legal Citation 9th ed. Bibliography is required but wont count towards total word count. Should be typed in size 12 font and given 1.5 line spacing
